GRIVAS & JO — Statutory Warranty
Version 1.0 — October 2026
1. Statutory Warranty Rights
If you are a consumer purchasing an artwork from GRIVAS & JO, you have statutory warranty rights under applicable Austrian consumer law.
These rights apply independently of the statutory right of withdrawal and are not affected by the expiry of the 14-day withdrawal period.
2. Warranty Period
GRIVAS & JO is responsible for defects that exist when the artwork is handed over to the customer and that become apparent within the applicable statutory warranty period.
For artworks and other movable goods, the statutory warranty period is generally two years from handover of the artwork.
3. What Is a Defect?
An artwork may be defective or non-conforming if it does not have the characteristics agreed in the contract or does not meet the applicable statutory conformity requirements.
Minor variations that are inherent in the nature of an artwork or production method are not automatically defects.
In particular, screen displays, lighting and materials may cause colours or appearance to differ slightly from digital images shown in the Gallery.
4. Repair or Replacement
Where statutory warranty rights apply, the consumer generally has the right in the first instance to choose between:
- Repair (Verbesserung)
- or
- Replacement (Austausch)
subject to the conditions and limitations provided by applicable law, including where the chosen remedy would be impossible or would impose disproportionate costs compared with the alternative remedy.
Repair or replacement will be provided within a reasonable period and without cost to the consumer where required by law.
If the consumer chooses repair, the applicable statutory warranty period is extended once by one additional year in accordance with Austrian law.
5. Price Reduction or Termination of the Contract
Depending on the circumstances and the requirements of applicable law, the consumer may instead become entitled to an appropriate price reduction or termination of the contract, particularly where repair or replacement is impossible, refused, unsuccessful, not completed within a reasonable period or would cause significant inconvenience.
An insignificant defect does not generally entitle the consumer to terminate the contract.
6. Returning an Artwork in a Warranty Case
If an artwork needs to be returned, repaired or replaced under the statutory warranty, please contact GRIVAS & JO before returning it so that the appropriate arrangements can be made.
GRIVAS & JO will bear costs for which the seller is legally responsible in connection with a valid statutory warranty remedy.
7. Collection Inspection
Customers are encouraged to inspect the artwork for visible damage or obvious defects when collecting it.
Confirmation that the artwork was collected, or that no visible damage was identified at collection, does not waive or restrict mandatory statutory warranty rights.
8. Withdrawal and Warranty Are Different
The statutory warranty is separate from the 14-day right of withdrawal applicable to qualifying distance contracts.
The right of withdrawal generally allows a consumer to withdraw from a qualifying distance contract without giving a reason during the applicable withdrawal period.
Statutory warranty rights concern defects or non-conformity of the artwork.
Expiry of the withdrawal period therefore does not mean that statutory warranty rights have expired.
9. Contacting GRIVAS & JO About a Defect
If you believe that an artwork is defective or does not conform to your order, please contact:

Please provide your Order Number or ART ID where available and describe the issue. Photographs may be provided where they help us understand the problem.
10. Mandatory Consumer Rights
Nothing in this information excludes, limits or replaces mandatory statutory consumer warranty rights.
Where applicable law provides the consumer with rights beyond those described on this page, those statutory rights remain unaffected.
