GRIVAS & JO — Terms of Sale
Version 1.2 — October 2026
1. Scope
These Terms of Sale apply to:
- artworks purchased through the online checkout ("Buy Now") of the GRIVAS & JO online Art Gallery;
- Order Requests submitted through the Gallery for collection-only orders; and
- Custom Artwork commissions agreed individually with the customer, including requests originating through the Contact form, email or social media and subsequently recorded by GRIVAS & JO as a Custom Artwork order.
Section 8 contains additional provisions that apply only to Custom Artwork. Mandatory consumer-protection law takes precedence over these Terms (Section 17).
The seller is GRIVAS & JO (Natalia Griva), Vienna, Austria, email info@grivasjo.com. Further company information is available in the Impressum.
2. Artworks, Availability and Preparation Times
The artwork's title, type (original hand-painted artwork or print), dimensions, price and other relevant characteristics are shown on the Gallery page and in the order summary.
Hand-Painted Artworks and Guided Painting Techniques
Our hand-painted collection includes artworks created through different artistic techniques, including freehand painting and guided painting methods such as Paint by Numbers (PBN).
Guided painting involves a pre-designed composition that serves as the foundation for the artwork. Each piece is individually painted by hand, with the artist applying colours, developing details and, where applicable, making artistic adjustments throughout the process.
Depending on the artwork, these adjustments may include colour modifications, additional layers, refined lighting, enhanced textures and changes to individual elements of the original composition.
The finished artwork is a physically hand-painted piece, not a mechanically reproduced print. Subtle variations in colour, texture, brushwork and detail may occur.
The specific technique used is accurately identified in the individual artwork description.
Each size of an artwork is offered as either:
- Available Now — the artwork is ready or can be prepared at short notice; or
- Made to Order — the artwork is produced or finished after the order is placed.
The estimated preparation time for each size is shown on the artwork page and in the checkout before the order is placed. Preparation times are estimates and are counted from confirmation of the order (Buy Now: confirmed payment; Order Request: acceptance). Shipping time for Delivery orders is additional (Section 6).
"Made to Order" describes how the artwork is produced. It does not by itself mean that the artwork is personalised or custom-made in the legal sense, and does not by itself exclude the right of withdrawal (Section 10).
Colours and appearance displayed on a screen may vary slightly from the physical artwork due to differences in screens, materials and production.
3. Online Checkout (Buy Now) and Contract Formation
- The customer selects the artwork, size, quantity and fulfilment method (Pickup or Delivery), enters the required details, reviews the order summary including all charges, accepts these Terms of Sale, acknowledges the Withdrawal & Returns information, and proceeds to payment.
- By completing the payment with the button labelled as an obligation to pay, the customer submits a binding offer to purchase.
- The contract is concluded when the payment has been successfully confirmed and GRIVAS & JO sends the order confirmation by email. If payment is not completed, fails or expires, no contract and no order are created.
- Errors in the entered details can be corrected before payment by using the checkout form and its back navigation.
- The contract language is English. The order confirmation contains the main order details; these Terms and the Withdrawal & Returns information remain available on the website, and the versions accepted are recorded with the order.
4. Order Requests (Collection Only)
The Order Request process is a separate, collection-only process:
- Submitting an Order Request does not create a contract or a payment obligation. GRIVAS & JO reviews the request and confirms whether it can be fulfilled.
- If GRIVAS & JO accepts the request, it sends an Acceptance & Payment Details communication. The contract is concluded with that acceptance.
- The customer must not make payment before receiving the Acceptance & Payment Details communication.
- Order Requests are collected from a listed pickup location or another collection location expressly agreed with GRIVAS & JO; they are not shipped.
5. Prices and Payment
Prices. All prices are in euros. The total payable — artwork price, any shipping charge and any discount — is shown before the customer places the order (Buy Now) or submits the Order Request, and is confirmed in the order confirmation or acceptance. Tax information is displayed in accordance with GRIVAS & JO's current tax status.
Online checkout payment methods. Payment is made through Stripe's secure payment form, using debit or credit card, Apple Pay, Google Pay or Stripe Link, depending on the customer's device and browser. Payment is due at the time of the order. Card details are entered directly with Stripe and are not received by GRIVAS & JO (see the Privacy Policy).
Manual bank transfer. For Order Requests, Custom Artwork and other individually arranged sales, payment is made by bank transfer according to the payment details and reference provided by GRIVAS & JO, within the period stated in those details.
6. Fulfilment: Pickup or Delivery
Pickup. The customer selects a listed pickup location (or one expressly agreed with GRIVAS & JO). The confirmed collection location is communicated to the customer, and the customer is notified when the artwork is ready for collection. Pickup is free of charge. For Pickup, the preparation time shown on the artwork page applies (Section 2).
Delivery. Buy Now orders can be delivered to addresses in Austria and Greece. Shipments are sent with Austrian Post (Österreichische Post AG), which may use partner postal operators in the destination country.
Shipping charges. Shipping is charged once per order, regardless of the number of artworks:
| Destination | Shipping charge |
|---|---|
| Austria | EUR 5 per order |
| Greece | EUR 30 per order |
| Pickup | Free |
The shipping charge and the final total are shown in the checkout before payment.
Oversized artworks. Certain sizes require special shipping arrangements. For these sizes, the standard shipping charge does not apply and online payment with Delivery is not available; the customer may choose Pickup or request an individual shipping quotation. Payment for delivery of an oversized artwork is accepted only after the customer has agreed to the quoted shipping cost.
Estimated delivery. The total estimated delivery time — including production and shipping — depends on availability, artwork type and destination, and is shown on the artwork page, in the checkout, in the order confirmation and in Track Your Order:
| Category | Austria | Greece |
|---|---|---|
| Available Now — all artworks | 2–5 business days | 5–7 business days |
| Made to Order — Art Prints | 5–7 business days | 7–10 business days |
| Made to Order — Hand-painted | 30 calendar days | 30 calendar days |
Made to Order — Hand-painted: before payment, the customer must expressly agree in the checkout to the displayed estimated delivery time (30 calendar days to Austria and to Greece). Payment cannot proceed without this agreement.
Business days are Monday to Friday, excluding public holidays. Calendar days include weekends and public holidays. All delivery times are counted from confirmation of payment. Delivery times are estimates unless expressly agreed otherwise. The estimate applicable at the time of the order is saved with the order. If GRIVAS & JO cannot deliver within 30 days of the contract (or a later agreed date), the customer's statutory rights apply.
Tracking. When the artwork is dispatched, the customer receives a dispatch notification with the carrier and, where available, the tracking number and tracking link. Status can also be followed through Track Your Order. The customer must provide a correct and complete delivery address and contact telephone number.
Risk of loss. For consumers, the risk of loss or damage passes only when the artwork has been delivered to the customer or to a third party designated by the customer (other than the carrier). Loss or damage in transit is borne by GRIVAS & JO.
Custom Artwork. Collection in Vienna or another delivery arrangement individually agreed with the customer. Any delivery or shipping cost is agreed before payment.
7. Collection and Delivery Confirmation
At collection, the customer may be asked to scan the order-specific QR code and confirm physical collection. For Delivery, the customer may confirm receipt through a secure link or QR code; GRIVAS & JO may also record collection or receipt on the customer's behalf.
Customers are asked to inspect the artwork and packaging on collection or receipt and to report visible transport damage as soon as possible, ideally with photos, to info@grivasjo.com. This helps with carrier claims but is not a condition for the customer's statutory rights.
A collection or receipt confirmation records only the date and fact of physical handover or receipt. It does not confirm that the artwork is free of defects and does not waive or limit the right of withdrawal, statutory warranty rights or any other mandatory consumer rights.
8. Custom Artwork
Custom Artwork is created individually according to the specifications agreed with the customer.
Before production begins, the customer and GRIVAS & JO agree the relevant details of the artwork, such as the concept, subject, size, price and estimated completion time. Where a concept is prepared, it is shared with the customer for approval.
For Custom Artwork orders recorded by GRIVAS & JO, these Terms of Sale and the Withdrawal & Returns information are provided to the customer together with the payment request. By proceeding with payment after receiving this information, the customer confirms the order and accepts these Terms of Sale.
Once the agreed concept and specifications have been approved and production has begun, requested changes cannot be guaranteed and may require additional time and/or cost, which will be agreed with the customer before being carried out.
Hand-painted artwork is created individually by hand. Minor variations from an approved digital or reference concept in brushwork, colour tone, texture and artistic detail are inherent to the hand-painted process and do not by themselves constitute a defect. This does not limit the customer's statutory rights where an artwork is defective, damaged or does not conform to the agreed specifications.
9. Cancellation Before Dispatch or Collection
Customers may contact GRIVAS & JO or use the online Cancel / Withdraw from Order function at any time before dispatch or collection. Where the statutory right of withdrawal applies, such a request is treated as a withdrawal under Section 10.
10. Statutory Right of Withdrawal
Consumers who conclude a distance contract (including Buy Now orders and Order Requests concluded remotely) have the statutory right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period ends 14 days after the day on which the customer, or a third party indicated by the customer other than the carrier, takes physical possession of the artwork. For orders with several artworks delivered separately, it ends 14 days after the last artwork is received.
To exercise the right, the customer must inform GRIVAS & JO by a clear statement — for example by email to info@grivasjo.com, through the online Cancel / Withdraw from Order function, or using the model withdrawal form in the Withdrawal & Returns information. Sending the notice before the period expires is sufficient.
Exception. The right of withdrawal does not apply to goods that are made to the consumer's specifications or clearly personalised (§ 18(1)(3) FAGG). This exception applies only where the artwork is actually produced according to the customer's individual choices or specifications (for example a Custom Artwork commission or an approved personalisation). The label "Made to Order" alone, or production after ordering from the standard Gallery range, does not exclude the right of withdrawal. Where the exception applies, the customer is informed before ordering.
Full details, including the model withdrawal form, are in the Withdrawal & Returns information. Expiry of the withdrawal period does not affect statutory warranty rights.
11. Returns After Withdrawal
The customer must return or hand over the artwork without undue delay and in any event no later than 14 days after notifying the withdrawal. The deadline is met if the artwork is sent before the 14 days expire.
Return shipping costs:
| Situation | Who pays the return |
|---|---|
| Withdrawal without a defect ("change of mind") — Delivery orders | The customer pays the direct cost of returning the artwork |
| Pickup orders | Free of charge if returned in person at a location agreed with GRIVAS & JO (or by post at the customer's cost) |
| Defective, incorrect or transport-damaged artwork | GRIVAS & JO pays all necessary return and replacement shipping costs (Section 13) |
The direct return cost depends on the parcel's dimensions, weight and the country it is sent from, and is charged by the carrier chosen by the customer. GRIVAS & JO does not charge any additional fee.
Oversized artworks. Where an artwork, because of its size, cannot normally be returned by post, GRIVAS & JO states the estimated return cost before purchase, together with the individual shipping quotation (Section 6).
Customers are advised to pack the artwork securely, ideally in the original packaging, and use a trackable shipment. The artwork is returned to the address provided by GRIVAS & JO.
The customer is liable only for any diminished value of the artwork resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
12. Refunds
After a valid withdrawal, GRIVAS & JO refunds all payments received for the withdrawn artwork, including the original standard delivery charge, without undue delay and no later than 14 days after receiving the withdrawal notice.
- If the customer chose a delivery method more expensive than the standard delivery offered, the additional cost is not refunded.
- For partial withdrawal of a multi-unit order, the delivery charge is refunded where and to the extent required by law.
- The refund is made using the same payment method the customer used (card, Apple Pay, Google Pay or Stripe Link through Stripe; bank transfer to the customer's account for bank-transfer payments), unless expressly agreed otherwise. The customer is not charged any fees for the refund.
- GRIVAS & JO may withhold the refund until it has received the artwork back or the customer has supplied evidence of having sent it back, whichever is earlier — unless GRIVAS & JO has offered to collect the artwork itself.
Submitting an online withdrawal does not by itself mean that a refund has already been processed. Refunds are documented with a credit note where required.
13. Defective, Incorrect or Transport-Damaged Artworks
If an artwork is defective, not as ordered or damaged in transport, the customer has the statutory warranty rights (Section 14). In these cases GRIVAS & JO bears all necessary costs, including return shipping, collection, repair, replacement and redelivery; the customer is not charged. The customer should contact info@grivasjo.com before returning the artwork, so that GRIVAS & JO can provide a prepaid return or arrange collection. Any reimbursement of costs reasonably incurred by the customer is made in accordance with law.
14. Statutory Warranty Rights
Customers retain their statutory warranty rights (Gewährleistung) under Austrian law, in particular the Consumer Warranty Act (VGG), for defects existing at the time of handover. The warranty period for goods is generally two years from handover. Remedies are primarily repair or replacement and, where these are not possible or appropriate, price reduction or termination of the contract.
Collection or receipt confirmation, inspection at handover and expiry of the withdrawal period do not remove statutory warranty rights. Further information is available on the Statutory Warranty page.
15. Contact and Complaints
Questions, complaints, withdrawal notices and other communications concerning an order may be sent to GRIVAS & JO, info@grivasjo.com. Customers should include their Order Number where possible.
16. Privacy
Personal data required to process Gallery orders, payments, Pickup and Delivery, order tracking, withdrawals, returns and refunds is handled in accordance with the GRIVAS & JO Privacy Policy (Version 1.3).
17. Mandatory Consumer Rights and Governing Law
Nothing in these Terms excludes or restricts mandatory consumer rights that cannot legally be excluded or restricted. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers, this choice of law does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence (for example Greece).
